These Terms of Service govern your use of S Kainth Migration website, consultation booking systems, and professional migration advisory services. By accessing our platform or engaging our services, you agree to these terms.

1. Regulatory Framework & MARA Compliance

S Kainth Migration operates under the regulatory oversight of the Migration Agents Registration Authority (OMARA) in Australia. All registered migration agents in our firm strictly adhere to the Migration Agents Code of Conduct statutory framework prescribed under Section 314 of the Migration Act 1958.

2. Scope of Migration Advisory Services

Our services encompass initial consultation, eligibility evaluation, points calculation, document compilation, Skills Assessment filing, state nomination submissions, and Department of Home Affairs visa application representation.

Important Notice: Initial consultations provide preliminary eligibility assessments based on current migration laws and client-supplied information. A formal Client Agreement (Contract) must be executed before full visa representation commences.

3. Client Obligations & Truthful Information

As a client, you agree to provide complete, authentic, and truthful information regarding your identity, qualification history, work experience, English scores, and visa history. Providing fraudulent or misleading documentation to migration agents or Home Affairs is illegal under Australian law (Public Interest Criterion 4020).

4. Consultation Fees, Payments & Cancellations

  • Consultation Fees: Consultation booking fees (e.g. A$150.00 incl. GST) must be paid at the time of booking via our secure Stripe payment portal.
  • Rescheduling: You may reschedule your consultation up to 24 hours prior to your scheduled time without penalty.
  • Cancellations & Refunds: Consultation fees are non-refundable for cancellations made less than 24 hours prior to appointment time or for no-show appointments.

5. No Guarantee of Visa Outcome

In compliance with MARA regulations, S Kainth Migration provides professional legal advocacy but does NOT guarantee visa approval, state nomination grant, or processing timelines. Final decision-making authority rests exclusively with the Australian Department of Home Affairs, relevant assessing authorities, or review tribunals.

6. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Victoria and the Commonwealth of Australia. Any disputes shall be subject to the exclusive jurisdiction of Australian courts.
