Offshore Partner Visa (Subclass 309 / 100)
309/100Stage 1 — Subclass 309 — Temporary
Lodged while you are outside Australia. Allows you to travel to and enter Australia while your permanent visa is processed.
Stage 2 — Subclass 100 — Permanent
Automatically granted after assessment of your relationship if criteria are met; no separate application needed.
Onshore Partner Visa (Subclass 820 / 801)
820/801Stage 1 — Subclass 820 — Temporary
Lodged while you are inside Australia. You can remain in Australia and work while your permanent visa is processed.
Stage 2 — Subclass 801 — Permanent
Granted after 2 years of partnership if relationship is genuine and ongoing. No new application is required.

De Facto
In a genuine de facto relationship for at least 12 months prior to application. Same-sex couples are fully eligible.
Engaged (for Subclass 300)
Intending to marry your Australian sponsor within 9 months of visa grant (Prospective Marriage Visa).
Eligibility Requirements
Documents Required for Partner Visa
- Identity documents: passports, birth certificates.
- Proof of relationship: joint bank statements, rental agreements, social media/photos.
- Evidence of cohabitation: utility bills, shared address on official documents.
- Marriage or de facto evidence: marriage certificate / statutory declaration.
- Sponsor's Australian citizenship or PR evidence (e.g. passport, travel visa grant).
- Health examinations from an approved BUPA or panel physician clinic.
- Police clearance certificates for all countries resided in for 12+ months.
