How the Prospective Marriage Visa Works

Sponsor Approval

Your Australian fiancé(e) must apply to be approved as your sponsor with the Department of Home Affairs.

Lodge Subclass 300 Application

Apply for the Prospective Marriage Visa from outside Australia along with all supporting documents and relationship evidence.

Travel to Australia & Marry

Once granted, travel to Australia. You must marry your sponsor within 9 months of visa grant.

Apply for Partner Visa (820/801)

After the marriage, apply onshore for the Partner Visa Subclass 820 (temporary) which leads to Subclass 801 (permanent).

Critical: 9-Month Marriage Requirement

You must marry your Australian sponsor within 9 months of the Subclass 300 visa being granted. This deadline cannot be extended. If you do not marry within this period, the visa will expire and you must leave Australia.

Eligibility — Applicant (Overseas)

Be outside Australia at the time of application lodgement.

Have a genuine intention to marry your Australian sponsor within 9 months of visa grant.

Have met your sponsor in person at least once as adults.

Your sponsor must be an Australian citizen, permanent resident, or eligible NZ citizen.

Neither you nor your sponsor may be currently married to another person.

Both you and your sponsor must be at least 18 years of age.

Satisfy health and character requirements.

Sponsorship Requirements (Australian Partner)

Be an Australian citizen, Australian permanent resident, or eligible New Zealand citizen.

Not be currently married, engaged, or in a de facto relationship with another person.

Have met the applicant in person as adults (both over 18) at least once.

Not have previously sponsored 2 or more partners for a visa.

Not have sponsored a partner for a Subclass 300 visa in the past 5 years.

Pass a national police check and character assessment.

Both parties' birth certificates.
If previously married: divorce or death certificates.
Police clearance certificates from all countries resided in for 12+ months.
Health examination results from an approved BUPA clinic or panel physician.
